Abstract
Protected «works» by copyright are every original literary and artistic production whatever may be the mode or form of its expression. However, the current regulatory framework does not clarify what should be understood by originality, does not specify what variety of artistic or literary work can be protected and, furthermore, leaves ideas unprotected, whether they are the creative manifestation itself or the component value of its content. Based on the study and the analysis of the doctrinal and jurisprudential contributions, this paper aims to provide solutions to the shortcomings posed by current protection of «works».
