Abstract

Investor-State dispute settlement, known as ISDS, has been subject of critique over the past few years because of the disturbing consequences it has provoked in the developing countries. In a very first moment, the Transatlantic Trade and Investment Partnership, known as TTIP, foresaw the inclusion of an ISDS clause. The contestation to this measure raised the possibility of establishing a Permanent Court. The objective of this research is to analyse the mechanism of action of ISDS and of the new Court proposed by the European Commission.
