Criminal liability of legal persons and mechanisms for its prevention

Abstract
Since 2010 the Criminal Code regulates criminal liability of legal persons. This new regime consists of a mixed model of vicarial liability and provides for the possibility of exempting companies from that responsibility if they try to prevent the commission of crimes by protocols of criminal compliance. The objective of this study is to analyze the current regime of criminal liability, with special attention to the basic elements of a criminal prevention protocol.
