Diversion in the pre-trial stage in the English criminal procedure

This study analyzes the criminal process in the English legal system, focusing on the pre-trial stage and the manifestations of the principle of opportunity by the criminal prosecution authorities (police and prosecutor's office). This will highlight not only the main differences with the Spanish system, but also the positive and negative aspects of the application of the main alternatives to criminal proceedings at this procedural stage. Finally, a series of possible improvements to the English system will be proposed so that, in turn, they can serve as a basis for the application of the principle of opportunity in the pre-trial stage in Spain, especially in future legislative reforms in this regard.
